The Laogai Museum is a museum in Dupont Circle , Washington, D.C. , United States, which showcases human rights in the People's Republic of China , focusing particularly on Láogǎi , the Chinese prison system of "Reform through Labor". The creation of the museum was spearheaded by Harry Wu , a well-known Chinese dissident who himself served 19 years in laogai prisons; it was supported by the Yahoo! Human Rights Fund. It opened to the public on 12 November 2008, and Wu's non-profit research organization (the Laogai Research Foundation ) calls it the first museum in the United States to directly address the issue of human rights in China. It is now permanently closed.

117-482: The Chinese penal system includes numerous components such as prisons (formerly referred to as laogai ), re-education through labor or laojiao camps, ankang mental health facilities, and juvenile detention centers. The Laogai Museum focuses mainly on the laogai component, which Wu's non-profit research organization calls "the most extensive system of forced labor camps in the world.". Prisoners in these camps are said to undergo forced labor and thought reform, and

The Laogai Research Foundation also classifies psychiatric facilities, or ankang , as a form of detention for political dissidents, although it is not officially recognized as part of

351-505: A combination of disease and warfare, and recovery took generations. Han and Hui merchants were initially only allowed to trade in the Tarim Basin; their settlement in the Tarim Basin was banned until the 1830 Muhammad Yusuf Khoja invasion , when the Qing rewarded merchants for fighting off Khoja by allowing them to settle in the basin. The Uyghur Muslim Sayyid and Naqshbandi Sufi rebel of

Some human rights groups claim that as many as 10,000 Falun Gong members were detained in between 1999 and 2002, with as many as 5,000 detained in 2001. More recent estimates suggest that hundreds of thousands of Falun Gong adherents are imprisoned in China, with some sources estimating up to half of the official reeducation through labor camp population

585-687: A documented history of at least 2,500 years, a succession of people and empires have vied for control over all or parts of this territory. The territory came under the rule of the Qing dynasty in the 18th century, which was later replaced by the Republic of China . Since 1949 and the Chinese Civil War , it has been part of the People's Republic of China. In 1954, the Chinese Communist Party (CCP) established

702-521: A focus of discussion not only among foreign human rights groups, but also among legal scholars in China, some of whom were involved in the drafting of the 2007 laws meant to replace the system. In addition to legal scholars, the Supreme People's Court of the People's Republic of China had criticized the system. In light of the widespread disapproval of the system, HRIC called in 2001 for the system to be abolished entirely. Among its criticisms it cited

819-485: A fund established by Yahoo! after the company attracted criticism for helping Chinese police locate and detain internet dissidents. The fund, headed by Yahoo! co-founder Jerry Yang was part of Yahoo!'s apology, and funding the museum was one of its first public projects. A spokesman for the Chinese embassy has criticized the museum, calling it an attack on China's reputation and suggesting that Wu's motivation behind opening

936-557: A large archive of prison-made products, victims' testimonies, and Chinese government documents. The museum appeared to have closed in early 2017 following the death of its founder in April 2016, who had been criticised for excessive spending on the museum, rather than on human rights activists themselves. The museum reopened in October 2018. The museum was funded in part by the Yahoo! Human Rights Fund,

1053-437: A law allowing lawyers to offer legal counsel in re-education through labor cases. Many human rights groups, however, doubted the efficacy of the proposed reforms, saying that the new laws would only help minor criminals and not help political prisoners, and the reforms would not actually abolish the re-education through labor system. The Laogai Research Foundation stated that lowering the maximum length of detention and changing

1287-570: A positive step forward for human rights, but the fundamental problems of arbitrary detention remain in China: Many of the policies and practices which resulted in individuals being punished for peacefully exercising their human rights by sending them to RTL have not fundamentally changed: quite the contrary. There is ample evidence that such policies and practices are continuing in full force. The latest anti-Falun Gong campaign, launched earlier this year and intended to operate for three years, shows that

Human Rights Watch has stated that

1521-632: A result of a long struggle with the Dzungars which began during the 17th century. In 1755, with the help of the Oirat noble Amursana , the Qing attacked Ghulja and captured the Dzungar khan. After Amursana's request to be declared Dzungar khan went unanswered, he led a revolt against the Qing. Qing armies destroyed the remnants of the Dzungar Khanate over the next two years, and many Han Chinese and Hui moved into

1638-552: A wider context than people who were accused of committing minor crimes and political dissidence. By 2017, these had become the massive Xinjiang internment camps holding 1–3 million people, utilizing forced labor, now recognized as re-education camps by many nations and intergovernmental organizations such as the UN , EU , and human rights groups. The People's Republic of China employs several forms of correction for people who have been arrested, of which re-education through labor

This created an economic imbalance, since the northern Junghar basin (Dzungaria) is more developed than the south. Land reform and collectivization occurred in Uyghur agricultural areas at the same general pace as in most of China. Hunger in Xinjiang

2106-412: Is not given to mountains and rivers. It is given to particular nationalities." Some Uyghur Communists proposed the name " Tian Shan Uyghur Autonomous Region" instead. The Han Communists in the central government denied the name Xinjiang was colonialist and denied that the central government could be colonialists both because they were communists and because China was a victim of colonialism. However, due to

The 1765 Ush rebellion by

2340-488: The Bronze Age linked to the expansion of early Indo-Europeans . These population dynamics gave rise to a heterogeneous demographic makeup. Iron Age samples from Xinjiang show intensified levels of admixture between Steppe pastoralists and northeast Asians, with northern and eastern Xinjiang showing more affinities with northeast Asians, and southern Xinjiang showing more affinity with central Asians. Between 2009 and 2015,

4212-608: The 1860s, Xinjiang had been under Qing rule for a century. The region was captured in 1759 from the Dzungar Khanate , whose population (the Oirats ) became the targets of genocide. Xinjiang was primarily semi-arid or desert and unattractive to non-trading Han settlers, and others (including the Uyghurs) settled there. The Dungan Revolt by the Muslim Hui and other Muslim ethnic groups

4329-524: The 1990s to the 2010s, the East Turkestan independence movement , separatist conflict and the influence of radical Islam have resulted in unrest in the region with occasional terrorist attacks and clashes between separatist and government forces. These conflicts prompted the Chinese government to commit a series of ongoing human rights abuses against Uyghurs and other ethnic and religious minorities in

4446-553: The Afaqi Khoja leader Burhan-ud-din and his brother, Khoja Jihan, from Dzungar imprisonment and appointed them to rule the Tarim Basin as Qing vassals. The Khoja brothers reneged on the agreement, declaring themselves independent leaders of the Tarim Basin. The Qing and the Turfan leader Emin Khoja crushed their revolt, and by 1759 China controlled Dzungaria and the Tarim Basin. The Manchu Qing dynasty gained control of eastern Xinjiang as

4563-595: The Afaqi and the Afaq Khoja invited the 5th Dalai Lama (the leader of the Tibetans ) to intervene on his behalf in 1677. The Dalai Lama then called on his Dzungar Buddhist followers in the Dzungar Khanate to act on the invitation. The Dzungar Khanate conquered the Tarim Basin in 1680, setting up the Afaqi Khoja as their puppet ruler. After converting to Islam, the descendants of the previously- Buddhist Uyghurs in Turfan believed that

4680-727: The CCP's determination to rid China of this spiritual group has not abated. Falun Gong practitioners continue to be punished through criminal prosecution and being sent to "brainwashing centres" and other forms of arbitrary detention. Petitioners likewise continue to be subjected to harassment, forcibly committed to mental institutions and sent to "black jails" and other forms of arbitrary detention. Human rights defenders, democracy advocates, whistle-blowers and other political activists are also being increasingly targeted through criminal detention, "black jails", short-term administrative detention, and enforced disappearances, rather than RTL. 8424-521: The general prison system; furthermore, detainees in these re-education facilities receive a small salary, which laogai detainees do not, and in theory have shorter work hours. The laogai system is much larger than the re-education through labor system, with the Laogai Research Foundation identifying 1,045 laogai camps in 2006 (compared to 346 re-education centers). Both systems, however, involve penal labor and often do not allow trials or judicial hearings . The term "reform through labor" or laogai

8541-571: The gradual Gaitu Guiliu administrative reform, including regions in Southern China. For instance, present-day Jinchuan County in Sichuan was then known as "Jinchuan Xinjiang", Zhaotong in Yunnan was named directly as "Xinjiang", Qiandongnan region, Anshun and Zhenning were named as "Liangyou Xinjiang" etc. In 1955, Xinjiang Province was renamed "Xinjiang Uygur Autonomous Region". The name that

8658-603: The individuals under trial have sometimes been convicted on the basis of confessions that were coerced through "torture and severe psychological pressure." In at least one instance, convicted individuals were sent to re-education through labor even after being found not guilty in a trial. Most detainees in re-education through labor facilities are reported to be drug users, petty criminals, and prostitutes, as well as some political prisoners; James Seymour has also claimed that most individuals sentenced to re-education through labor are from urban areas. Individuals who attempt to leave

8775-631: The labor done by re-education through labor detainees is geared towards agriculture or producing goods, many of which are sold internationally, since re-education through labor detainees are not counted as official "prisoners" and therefore not subject to international treaties. They also perform work ranging "from tending vegetables and emptying septic pits to cutting stone blocks and construction work." Although drug abusers are ostensibly placed in re-education through labor to be treated for their addictions, some testimonial evidence has suggested that little "meaningful treatment" takes place in at least some of

8892-781: The largest numbers of re-education centers include Guangdong, Liaoning, Heilongjiang, and Henan. At the end of 2008, there were 350 labor camps and 160,000 prisoners were being held in them. Sentencing for re-education through labor is generally carried out by the police rather than by the judicial system, so individuals are rarely charged or tried before being detained. Public security bureaus (police offices) are able to carry out administrative detentions for "minor" infringements that are not considered criminal acts; at least one analyst has suggested that local public security bureaus often abuse their authority and detain individuals for things such as personal vendettas. Individuals may also be sentenced to re-education through labor by courts, but

9009-461: The last nomadic empires . The Dzungar Khanate covered Dzungaria, extending from the western Great Wall of China to present-day Eastern Kazakhstan and from present-day Northern Kyrgyzstan to Southern Siberia . Most of the region was renamed "Xinjiang" by the Chinese after the fall of the Dzungar Empire, which existed from the early 17th to the mid-18th century. The sedentary Turkic Muslims of

9126-452: The late 1870s from Yaqub Beg, the Qing dynasty established Xinjiang ("new frontier") as a province in 1884  – making it part of China, and dropping the old names of Zhunbu ( 準部 , Dzungar Region) and Huijiang (Muslimland). After Xinjiang became a Chinese province, the Qing government encouraged the Uyghurs to migrate from southern Xinjiang to other areas of the province (such as

9243-455: The late 1970s has exacerbated uneven regional development, more Uyghurs have migrated to Xinjiang's cities and some Han have migrated to Xinjiang for economic advancement. Chinese leader Deng Xiaoping made a nine-day visit to Xinjiang in 1981 and described the region as "unsteady". The Deng era reforms encouraged China's ethnic minorities, including Uyghurs, to establish small private companies for commodity transit, retail, and restaurants. By

9360-529: The length for which detainees could be sentenced, and it was not until 1979 that a maximum sentence of four years (three years' sentence plus one-year extension) was set. In 1983, the management and implementation of the re-education through labor system was passed from the Ministry of Public Security to the Ministry of Justice . When Falun Gong was banned in mainland China in 1999, re-education through labor became

Crossed by the Northern Silk Road , the Tarim and Dzungaria regions were known as the Western Regions. At the beginning of the Han dynasty the region was ruled by the Xiongnu, a powerful nomadic people. During the 2nd century BC, the Han dynasty prepared for war against Xiongnu when Emperor Wu of Han dispatched Zhang Qian to explore

9594-798: The museum was "to vilify the Chinese legal system and mislead the American public." In response, Wu said that the Chinese authorities "always dismiss me as a morally corrupt and dangerous criminal. Their second argument is that criminals have to work in some American prisons, too. But I can tell you that it's not the same thing at all." 38°54′24″N 77°01′39″W / 38.9067°N 77.0276°W / 38.9067; -77.0276 Re-education through labor Re-education through labor ( RTL ; simplified Chinese : 劳动教养 ; traditional Chinese : 勞動教養 ; pinyin : láodòng jiàoyǎng ), abbreviated laojiao (simplified Chinese: 劳教 ; traditional Chinese: 勞教 ; pinyin: láojiào )

9711-533: The mysterious kingdoms to the west and form an alliance with the Yuezhi against the Xiongnu. As a result of the war, the Chinese controlled the strategic region from the Ordos and Gansu corridor to Lop Nor . They separated the Xiongnu from the Qiang people on the south and gained direct access to the Western Regions. Han China sent Zhang Qian as an envoy to the states of the region, beginning several decades of struggle between

9828-649: The names of the detention facilities would not constitute a "fundamental change". Nine months after the declaration that the laws would be rewritten, the re-education through labor system had not been abolished; in December 2007, a group of academics drafted an open letter to the government calling for an end to the system. During the 2008 Summer Olympics in Beijing , there were reports that some individuals who applied for permits to protest were detained without trial; of these, some were sentenced to re-education through labor. In

9945-518: The north-west who supplied jade to the Chinese from the nearby mountains (also known as Yushi) in Gansu. The longtime jade supply from the Tarim Basin is well-documented archaeologically: "It is well known that ancient Chinese rulers had a strong attachment to jade. All of the jade items excavated from the tomb of Fuhao of the Shang dynasty , more than 750 pieces, were from Khotan in modern Xinjiang. As early as

10062-403: The pacified areas. The native Dzungar Oirat Mongols suffered greatly from the brutal campaigns and a simultaneous smallpox epidemic. Writer Wei Yuan described the resulting desolation in present-day northern Xinjiang as "an empty plain for several thousand li , with no Oirat yurt except those surrendered." It has been estimated that 80 percent of the 600,000 (or more) Dzungars died from

10179-450: The past. What data have become available often vary widely. Of these detainees, 5 to 10 percent are estimated to be political prisoners, and as many as 40 percent are estimated to be drug offenders —in 1998, nearly one-third of the known re-education camps were specifically built for the purpose of holding drug offenders. The China Daily estimated that there were a total of 310 re-education centers in China in 2007. The 2008 edition of

10296-429: The possibility of an additional one-year extension. They were issued as a form of administrative punishment by police, rather than the judicial system. While they were incarcerated, detainees were frequently subjected to a form of political education . Estimates of the number of RTL detainees on any given year range from 190,000 to two million. In 2013, approximately 350 RTL camps were in operation. On 28 December 2013,

10413-426: The proportion of individuals who receive trials rather than going directly into administrative detention is determined in part by how much capacity that province has for re-education detainees—provinces with large re-education through labor apparatus generally allow fewer detainees to have trials. Where detainees have been allowed a trial, their lawyers have faced "intimidation and abuse," according to some reports, and

10530-720: The province and acceded in name to the Republic of China in March of that year. Balancing mixed ethnic constituencies, Yang controlled Xinjiang until his 1928 assassination after the Northern Expedition of the Kuomintang . The Kumul Rebellion and others broke out throughout Xinjiang during the early 1930s against Jin Shuren , Yang's successor, involving Uyghurs, other Turkic groups and Hui (Muslim) Chinese. Jin enlisted White Russians to crush

10647-502: The province including, according to some, genocide. The general region of Xinjiang has been known by many different names throughout time. These names include Altishahr , the historical Uyghur name for the southern half of the region referring to "the six cities" of the Tarim Basin , as well as Khotan, Khotay, Chinese Tartary , High Tartary, East Chagatay (it was the eastern part of the Chagatai Khanate ), Moghulistan ("land of

10764-459: The province to them. Five ETR leaders who were to negotiate with the Chinese about ETR sovereignty died in an airplane crash that year in the outskirts of Kabansk in the Russian SFSR . The PRC continued the system of settler colonialism and forced assimilation which had defined previous Chinese expansionism in Xinjiang. The PRC autonomous region was established on 1 October 1955, replacing

10881-519: The province; that year (the first modern census in China was taken in 1953), Uyghurs were 73 percent of Xinjiang's total population of 5.11 million. Although Xinjiang has been designated a "Uygur Autonomous Region" since 1954, more than 50 percent of its area is designated autonomous areas for 13 native non-Uyghur groups. Modern Uyghurs developed ethnogenesis in 1955, when the PRC recognized formerly separately self-identified oasis peoples. Southern Xinjiang

10998-427: The reform or total abolition of re-education through labor, China's security agencies have defended the use of the system as being necessary to maintain social stability. A 1997 report in China's Legal Daily hailed re-education through labor as a means to "maintain social peace and prevent and reduce crime." The Ministry of Public Security stated in 2005 that re-education through labor helped maintain rule of law and

In 1912, the Qing dynasty was replaced by the Republic of China . The ROC continued to treat the Qing territory as its own, including Xinjiang. Yuan Dahua, the last Qing governor of Xinjiang, fled. One of his subordinates, Yang Zengxin , took control of

11232-663: The region. The area became Islamified during the 10th century with the conversion of the Kara-Khanid Khanate , who occupied Kashgar. During the mid-10th century, the Saka Buddhist Kingdom of Khotan was attacked by the Turkic Muslim Karakhanid ruler Musa; the Karakhanid leader Yusuf Qadir Khan conquered Khotan around 1006. After Genghis Khan unified Mongolia and began his advance west the Uyghur state in

11349-562: The remains of 92 individuals in the Xiaohe Cemetery were analyzed for Y chromosome and mitochondrial DNA markers. Genetic analyses of the mummies showed that the paternal lineages of the Xiaohe people were of almost all European origin, while the maternal lineages of the early population were diverse, featuring both East Eurasian and West Eurasian lineages, as well as a smaller number of Indian / South Asian lineages. lineages. Over time,

11466-505: The revolts. In the Kashgar region on 12 November 1933, the short-lived First East Turkestan Republic was self-proclaimed after debate about whether it should be called "East Turkestan" or "Uyghuristan". The region claimed by the ETR encompassed the Kashgar , Khotan and Aksu Prefectures in southwestern Xinjiang. The Chinese Muslim Kuomintang 36th Division (National Revolutionary Army) defeated

11583-764: The same time. As Tibet and the Uyghur Khaganate declined in the mid-9th century, the Kara-Khanid Khanate (a confederation of Turkic tribes including the Karluks , Chigils and Yaghmas) controlled Western Xinjiang during the 10th and 11th centuries. After the Uyghur Khaganate in Mongolia was destroyed by the Kirghiz in 840, branches of the Uyghurs established themselves in Qocha (Karakhoja) and Beshbalik (near present-day Turfan and Ürümqi). The Uyghur state remained in eastern Xinjiang until

11700-478: The system has attracted widespread criticism from the international community. In 1994, the government abandoned the term laogai and renamed the facilities "prisons" ( jianyu ), but the Laogai Research Foundation and others claim that forced labor continues and prison conditions have not improved. The purpose of the Laogai Museum, according to Wu, is both to educate the public about the laogai and to memorialize

11817-644: The system violated items in the Chinese constitution . Wang Gongyi, vice-director of the Institute of Justice Research affiliated to the Ministry of Justice, said that the re-education through labor system contradicts several items in the Constitution, the Criminal Procedure Law, and the International Covenant on Civil and Political Rights , which China signed in 1998. Although many human rights groups and legal scholars both within and without China called for

11934-400: The time of the Qing conquest in 1759, Dzungaria was inhabited by steppe dwelling, nomadic Tibetan Buddhist Dzungar people, while the Tarim Basin was inhabited by sedentary, oasis dwelling, Turkic-speaking Muslim farmers, now known as the Uyghurs, who were governed separately until 1884. The Qing dynasty was well aware of the differences between the former Buddhist Mongol area to the north of

The museum also has

12168-503: The west Eurasian maternal lineages were gradually replaced by east Eurasian maternal lineages. Outmarriage to women from Siberian communities, led to the loss of the original diversity of mtDNA lineages observed in the earlier Xiaohe population. The Tarim population was therefore always notably diverse, reflecting a complex history of admixture between people of Ancient North Eurasian , South Asian and Northeast Asian descent. The Tarim mummies have been found in various locations in

A month later, Chongqing municipality passed

It was separated from the much larger laogai system of prison labor camps. Sentences under re-education through labor were typically for one to three years, with

12636-445: Was beaten to death, reportedly by other inmates and by the labor supervisor. Zhang's death, along with the March 2003 death of inmate Sun Zhigang in a custody and repatriation prison, sparked calls within China for reform of the system, although reforms were not made immediately. Though most reports describe the conditions of re-education camps as "brutal," there are some claims of prisoners being well-treated. For example, when he

12753-576: Was fought in China's Shaanxi , Ningxia and Gansu provinces and in Xinjiang from 1862 to 1877. The conflict led to a reported 20.77 million deaths due to migration and war, with many refugees dying of starvation. Thousands of Muslim refugees from Shaanxi fled to Gansu; some formed battalions in eastern Gansu, intending to reconquer their lands in Shaanxi. While the Hui rebels were preparing to attack Gansu and Shaanxi, Yaqub Beg (an Uzbek or Tajik commander of

12870-457: Was given to the region by the Qing, since it had distinct geography, history and culture, while at the same time it was created by the Chinese, multicultural, settled by Han and Hui and separated from Central Asia for over a century and a half. In the late 19th century, it was still being proposed by some people that two separate regions be created out of Xinjiang, the area north of the Tianshan and

12987-463: Was mainly used for rehabilitating lawbreakers. In 2007, when new laws were drafted, the Ministry of Public Security was opposed to the proposal that would allowing judicial review before punishment was enforced. In 1980, China allowed the United States to establish electronic listening stations in Xinjiang so the United States could monitor Soviet rocket launches in central Asia in exchange for the United States authorizing the sale of dual-use civilian and military technology and nonlethal military equipment to China. The Chinese economic reform since

13221-430: Was officially adopted into law to be implemented by the Ministry of Public Security . The law allowed police to sentence both minor offenders and "counter-revolutionaries" or "anti-socialist elements" to incarceration in labor camps without the right to a judicial hearing or trial , and did not allow judicial review to take place until after the punishment was being enforced. In the beginning there were no limits to

13338-503: Was officially replaced with "prison" in 1994, and the term "re-education center" or láojiàosuǒ (劳教所) was replaced with "correctional center" in 2007. Other components of the prison system include detention centers for individuals awaiting sentence or execution, and juvenile detention camps for individuals under a minimum age (which has varied through the years, and may currently be under 14). The system formerly included components such as custody and repatriation for individuals without

This proposal was not well-received by Uyghurs in the Communist Party, who found the name colonialist in nature since it meant "new territory". Saifuddin Azizi , the first chairman of Xinjiang, registered his strong objections to the proposed name with Mao Zedong , arguing that "autonomy

13689-559: Was released from a three-year re-education sentence in 1999, dissident Liu Xiaobo said that he had been treated very mildly, that he had been allowed to spend time reading, and that the conditions had been "pretty good." Forced labor may include breaking rocks and assembling car seat covers, and even gold farming in World of Warcraft. According to Chinese state media Xinhua , slightly over 50% of detainees released from prison and re-education through labor in 2006 received government aid in
