A constituent assembly (also known as a constitutional convention , constitutional congress , or constitutional assembly ) is a body assembled for the purpose of drafting or revising a constitution . Members of a constituent assembly may be elected by popular vote , drawn by sortition , appointed, or some combination of these methods. Assemblies are typically considered distinct from a regular legislature , although members of the legislature may compose a significant number or all of its members. As the fundamental document constituting a state, a constitution cannot normally be modified or amended by the state's normal legislative procedures in some jurisdictions; instead a constitutional convention or a constituent assembly, the rules for which are normally laid down in the constitution, must be set up. A constituent assembly is usually set up for its specific purpose, which it carries out in a relatively short time, after which the assembly is dissolved. A constituent assembly is a form of representative democracy .

Cardinal Sin went on radio and encouraged people on the capital to likewise go to EDSA to support Ramos and Enrile, and crowds, already preparing to conduct election protests, trooped en masse to

9546-517: The deadly series of bombings in 1971. For historian Joseph Scalice, he argued that while the Marcos government was allied with the Partido Komunista ng Pilipinas (PKP) in carrying out bombings in the early 1970s, "the evidence of history now overwhelmingly suggests that the Communist Party of the Philippines , despite being allied with the Liberal Party, was responsible for this bombing, seeing it as

9675-452: The end of January, 1981, and that only in a few areas where grave problems of public order and national security continue to exist will martial law continue to remain in force." After the lifting of martial law, power remained concentrated with Marcos. One scholar noted how Marcos retained "all martial law decrees, orders, and law-making powers", including powers that allowed him to jail political opponents. The martial law era under Marcos

9804-478: The end of the Marcos dictatorial era, the country was experiencing a debt crisis, extreme poverty , and severe underemployment. In 1965, Ferdinand Marcos won the presidential election and became the 10th president of the Philippines . His first term was marked with increased industrialization and the construction of nationwide infrastructure, including the creation of the North Luzon Expressway and

9933-644: The establishment of a Federal Republic and for the restoration of the Constituent Congress. Iturbide was forced to abdicate and he reinstalled the Constituent Congress. The Congress then created a provisional government, called the Triumvirate , and enacted the Constituent Act of the Mexican Federation, by which the former Provinces of Mexico were transformed into free and sovereign States. After this,

10062-525: The existing American constitutions, so that the constituent's assembly could draw upon the latest in constitutional design. The powers of these state constituent assemblies were also highly contested, with some claiming that they had unlimited legal power and others claiming that they must operate within the pre-existing legal landscape. In the end, a common law of constituent power emerged which held that elected constituent assemblies had limited powers. Several U.S. states have held multiple conventions over

10191-474: The fire truck and a government car. Protesters ran towards Arguelles Street to evade the explosions in front of the Palace. Student protesters were steadily driven out of J.P. Laurel and farther down Mendiola , where they built a barricade to stop the riot police and armed soldiers from the Palace. As students from nearby dormitories joined them, protesters grew in numbers. Everything was improvised and they did not have any organized plan. The protestors fought

10320-574: The following decade. During the Vietnam War , Marcos strongly opposed sending military forces to Vietnam. Under intense pressure from US President Lyndon Johnson , Marcos sent a Filipino noncombatant military force to the Republic of Vietnam in 1966, under the Philippine Civic Action Group (PHILCAG). As the war was proving to be unpopular among Filipinos, Marcos ordered the withdrawal of

10449-511: The formation of the Federal Constitution in 1787 as well as after its ratification. Since 1776 nearly 150 state constitutional conventions have met to draft or revise state constitutions. These early state constitutional conventions frequently did not use procedural steps like popular ratification that became commonplace in the mid-19th century. Yet they were considered to be constituent assemblies that exercised their authority as that of

10578-652: The government, siding with Enrile. Their respective forces barricaded themselves in Camp Crame and Camp Aguinaldo which were near each other on either side of Epifanio de los Santos Avenue (EDSA) in Quezon City . Despite their combined forces, however, Enrile and Ramos were essentially trapped in the camps, and in the words of historian Vicente L. Rafael , "became sitting ducks for Ferdinand Marcos' loyalist forces." A small contingent of Aquino supporters, led by her brother in law Butz Aquino , went to EDSA to express support

10707-468: The hand of Marcos. Violent dispersals of various FQS protests were among the first watershed events in which large numbers of Filipino students of the 1970s were radicalized against the Marcos administration. Due to these dispersals, many students who had previously held "moderate" positions (i.e., calling for legislative reforms) became convinced that they had no choice but to call for more radical social change. Similar watershed events would later include

10836-546: The largest rally to take place in Plaza Miranda. This rally was nearly called off when some conservative MDP leaders initially agreed to have a discussion with the President Marcos that evening, about concessions he was supposedly willing to offer if the leaders would call off the rally. However, KM leaders insisted on proceeding and made assurances that provocateurs would be kept out of the proceedings. History of

10965-415: The metal fence that separates them from the Palace. While this was happening, different student leaders were already in Malacañang having a meeting with Ferdinand Marcos to make the following demands: "the holding of a nonpartisan constitutional convention; the commitment that Marcos, a two-term president, would not suddenly change the rules forbidding a president from seeking a third term; the resignation of

11094-409: The military of prerogatives that made them appear superior to the civilian authorities below the president. In other words, the problem was what may be needed for national survival or the restoration of normalcy in the face of a crisis or an emergency should be reconciled with the popular mentality and attitude of the people against martial law. In a speech before his fellow alumni of the University of

11223-556: The moderate and radical camps; and for their scale, with the biggest one attended by as many as 50,000 people. The other broad category of student groups who participated in the first quarter storm were those who wanted broader, more systemic political reforms, usually as part of the National Democracy movement . These groups were branded "radicals" by the media, although the Marcos administration extended that term to "moderate" protest groups as well. Groups considered "radical" at

11352-492: The move, but later historians would note that the resulting Constitutional Convention laid the foundation for the legal justifications Marcos used to extend his term past the two four-year terms allowable under the 1935 Constitution. The first First Quarter Storm rally held on January 26, 1970, coincided with the State of the Nation Address where Marcos was expected to talk about the 1971 Constitutional Convention. The media reports of

11481-446: The next nine years, the excesses committed by the military increased. In total, there were 3,257 extrajudicial killings , 35,000 individual tortures, and 70,000 were incarcerated. It is also reported that 737 Filipinos disappeared between 1975 and 1985. Though it was claimed that martial law was no military take-over of the government, the immediate reaction of some sectors of the nation was of astonishment and dismay, for even though it

11610-469: The option to submit both its own proposals for amendments and those of a national convention to state conventions rather than the state legislatures for ratification; this process has been used only once (for the Twenty-first Amendment ). A long tradition in the use of constituent assemblies exists at the state level of Constitutionalism . In fact, constituent assemblies met in the states before

11739-601: The parallels between the state at current time and the state during the 1896 Philippine Revolution against Spain: If the brilliant students - Dr. Jose Rizal , Emilio Jacinto and Gregorio del Pilar - had merely concentrated on stale academic studies, and pursued successful professional careers and married well - in the accomplished style of Señor Pasta in El Filibusterismo - they would be worthless now to this nation, as worthless [...]. Our elders who take pride on their sheer age and their sense of caution should learn from

11868-453: The people. As American Sovereigns: The People and America's Constitutional Tradition Before the Civil War by Christian G. Fritz notes:. "A legitimate constitution depended on whether the sovereign people authorized it, not whether a particular procedure was used or whether revolutionary conventions were free of other responsibilities, such as passing ordinary legislation. It was the people as

11997-470: The presence of armed forces in the streets. Reactions in the international media were mixed: Singapore's Eastern Sun wrote that Marcos was right for "taking the hard line" in dealing with the demonstrators while an independent Chinese newspaper in Hong Kong thought otherwise. Both publications believed that the charge regarding the involvement of Chinese communists in the violence was exaggerated. Marcos saw

12126-432: The presidency for the third time. Marcos said that he was not interested in a third term and Jopson demanded that he put that down in writing, which led to Marcos lash out at him by calling him as merely the son of a grocer. The President did not agree to their terms and their meeting ended at around 6pm. As they headed to the front door of Malacañang Palace, they heard the sounds of glass breaking and pillboxes exploding. As

12255-512: The press, etc. In a word, the martial law regime was anathema to no small portion of the populace. It was in the light of the above circumstances and as a means of solving the dilemma aforementioned that the concept embodied in Amendment No. 6, giving the President emergency power in case of a threat or imminence to issue necessary decrees, orders which shall be part of law of the land, was born in

12384-445: The profligate rich, trouble for the denizens of this detestable establishment and abominable status quo [...] The convention must be scuttled or wrecked if it is dominated by the very same interests against which stands the very spirit of change inherent in convening a constitutional convention. For conceived in greed, born in mischief and nurtured in iniquity, the spirit of wanton capitalism has never failed to bend human institutions to

12513-651: The public to be polite to the country's visitors and display 'traditional Filipino hospitality,' expecting the KM to stage a demonstration. Furthermore, the Manila mayor's office announced that permits to demonstrate against the Manila Summit will not be issued. On the day before the beginning of the summit, as summiteers began to arrive, a group of students waved around name-calling placards, defending that they were not demonstrating, just picketing. They were taken by police and informed that they would be charged with demonstrating without

12642-469: The service of injustice and sin. To clarify, he explained that the word 'trouble' was used not in its literal sense, but rather that the youth should get involved in the coming convention, which they have been striving to do. Later "moderate" groups would include the Movement of Concerned Citizens for Civil Liberties or MCCCL, led by Senator Jose W. Diokno. The MCCCL's rallies are particularly remembered for their diversity, attracting participants from both

12771-673: The sovereign who authorized drafting those first [state] constitutions that gave them their legitimacy, not whether they used procedures that matched what was later understood to be necessary to create fundamental law." American state constituent assemblies in the 19th and 20th centuries reflected many qualities of a citizen's movement. From the start of state American constitution-making, delegates to constitutional conventions studied earlier state models of constitutions. They often self-consciously "borrow[ed]" constitutional text and provisions from other states. They often used in their drafting and debates compact and pocket-sized compilations of all

12900-492: The state and the church." The KM advocated for liberation from American imperialism, which "made the suffering of [the] people more complex and more severe." Their first demonstration, which took place at the U.S. Embassy on January 25, 1965, was held to this effect. The KM had since been active in various rallies and demonstrations such as those condemning the Laurel-Langley agreement , Parity Amendments, Mutual Defense treaty,

13029-600: The state visit of South Vietnam Premier Cao Ky in 1966, the state visit of President Marcos to the U.S., the October 24, 1966, Manila Summit conference, the killings of Filipinos in American bases, and the visit of President Nixon —events which they believe contribute to the feudalistic nature of the country. The rally held against the Manila Summit Conference on October 24 to 25, 1966, was among those that ended in violence. The media and government officials reminded

13158-487: The still-current Political Constitution of the United Mexican States of 1917. Nepal had two Constituent assemblies , the last one being elected after its predecessor failed to deliver a constitution, despite multiple extensions. It also served as the country's parliament. Finally Nepal had made constitution with 89% majority. Nepal has adopted Federalism since. The Great Sejm (also known as Four-Year Sejm )

13287-656: The stretch of EDSA between the two camps. This evolved in the largely peaceful 1986 EDSA Revolution , which ended with Marcos going into exile in Hawaii and Corazon Aquino becoming the 11th president of the Philippines on February 25, 1986. Under Aquino, the Philippines would adopt a new constitution, ending the Fourth Republic and ushering in the beginning of the Fifth Republic . Constitutional convention (political meeting) Unlike forms of constitution-making in which

13416-516: The students outside, the students threw rocks at the Palace in return. Protesters claimed that Malacañang guards started the violence by throwing pellets at them from inside, which led them to take over a fire truck and smashed it into Malacañang's Gate 4. Once the gate broke and gave way, bold protestors charged into the Palace grounds tossing rocks, pillboxes, Molotov cocktails . The Presidential Guard Battalion then came out in full force with their guns. The protestors drew back but not before inflaming

13545-401: The students' dialogue with the president was happening inside the Palace, the students outside the Palace were confronted with their own difficulties. Due to a loud call from someone outside the Palace to turn the lights on, the Palace did just that to accommodate the request, which led to a rock crashing to one of the lamps. Thinking that this was a rock thrown from inside the Palace and aimed at

13674-421: The time classified the various civil society groups opposing Marcos into two categories. The "Moderates", which included church groups, civil libertarians, and nationalist politicians, were those who wanted to create change through political reforms. 13932-483: The time included: A few days before the rally on January 26, Manuel F. Martinez, former Dawn (the weekly student newspaper of the University of the East ) editor commented: Now is the time for all troublemakers to come to the aid of the country. State legislatures put restrictions on conventions that were not followed in these cases. A few countries do not have an entrenched constitution , which can thus be amended by normal legislative procedures;

14190-500: The youth and the military. Students and military alternatively held Mendiola Bridge, until nine o'clock in the evening, when finally it finally fell to the military. While troops were able to disperse the militants, they failed to clear the streets of M. Aguila, Legarda , and Claro M. Recto and in Quiapo from other rallyists. Doors were opened to these rallyists, and through gestures from people at second-floor windows, they were warned about

14319-521: Was $ 3 / barrel in 1973 and $ 39.5 in 1979, or a growth of 1200% which drove inflation. Despite the 1984–1985 recession, GDP on a per capita basis more than tripled from $ 175.9 in 1965 to $ 565.8 in 1985 at the end of Marcos' term, though this averages less than 1.2% a year when adjusted for inflation. The government had

14835-665: Was claimed that the gravity of the disorder, lawlessness, social injustice, youth and student activism, and other disturbing movements had reached a point of peril, they felt that martial law over the whole country was not yet warranted. Worse, political motivations were ascribed to be behind the proclamation, since the then constitutionally non-extendable term of President Marcos was about to expire. This suspicion became more credible when opposition leaders and outspoken anti-Marcos media people were immediately placed under indefinite detention in military camps and other unusual restrictions were imposed on travel, communication, freedom of speech and
