Vallco Shopping Mall (formerly called Cupertino Square and originally Vallco Fashion Park ) is a mostly-demolished dead mall located in Cupertino, California , United States. Originally built as a single-story shopping mall in 1976 with a lower level added in 1988 and a third-level movie theater added in 2007, it was anchored for most of its existence by Macy's , Sears , and J.C. Penney . As of August 2022, the mall is owned by Sand Hill Property Co. and is almost entirely vacant, with Cupertino Ice Center (formerly the Ice Capades Chalet ), Bowlmor Lanes , and Benihana as the only remaining tenants, all in the section to the east of Wolfe Road. The larger western portion of the main mall structure was demolished in August 2019 and the pedestrian overpass was demolished in March 2020; plans for the site include a mixed-use development consisting of office space, housing, and retail.

133-501: A plan by Sand Hill to rebuild Vallco as a mixed-use development with retail, housing, and office space topped by a green roof park was cancelled after Cupertino voters rejected Measure D on the November 2016 ballot. After obtaining community input in the planning phase, the project ran into significant push-back from citizens who wanted to freeze the site as retail-only, citing concerns about traffic and schools. In 2018, Sand Hill proposed

266-479: A cool roof , a roof with solar thermal collectors or photovoltaic panels . Green roofs are also referred to as eco-roofs , oikosteges , vegetated roofs , living roofs , greenroofs and VCP H (Horizontal Vegetated Complex Partitions) Green roofs improve and reduce energy consumption. They can reduce heating by adding mass and thermal resistance value, and can reduce the heat island effect by increasing evapotranspiration . A 2005 study by Brad Bass of

399-426: A root barrier and drainage and irrigation systems. Container gardens on roofs, where plants are maintained in pots, are not generally considered to be true green roofs, although this is debated. Rooftop ponds are another form of green roofs which are used to treat greywater . Vegetation, soil, drainage layer, roof barrier and irrigation system constitute the green roof. Green roofs serve several purposes for

532-526: A 40 °C day in summer revealed that the surface temperature on the roof had reached 84 °C, while the shadows cast by the plants had reduced the surface temperature on the roof to 51 °C. The city of Toronto approved a by-law in May 2009 mandating green roofs on residential and industrial buildings. There is criticism from Green Roofs for Healthy Cities that the new laws are not stringent enough, since they will only apply to residential building that are

665-519: A French root, with a meaning similar to link , which is itself ultimately descended from the Latin ligamen , meaning "bond" and ligare , meaning "to bind". Mechanic's liens on property in the United States date from the 18th century. Mechanic's liens in their modern form were first conceived by Thomas Jefferson , to encourage construction in the new capital city of Washington . They were established by

798-540: A Hofbrau beer hall adjacent AMC Theatres. The bankruptcy filing in 2008 derailed these plans. In September 2008, the two owners of the complex filed for bankruptcy to prevent the primary financier, Gramercy Capital, from foreclosing on their property. According to Gramercy, the assets of the company fell well below the debt owed, though the consortium disputed this. In September 2009, Vietnamese food processing company Son Son Co. purchased Cupertino Square for US$ 64 million in an all-cash transaction. The new owners restored

931-404: A Notice of Unpaid Balance and Right to File Lien has been filed within 60 days of the lienor's last date of work and an arbitration award has been issued by an American Arbitration Association arbitrator permitting a mechanics lien to be filed. The act itself of filing a mechanics lien can be difficult. Most States simply require the filing of the mechanics lien with a county or court clerk within

1064-499: A building, such as absorbing rainwater , providing insulation , creating a habitat for wildlife, and decreasing stress of the people around the roof by providing a more aesthetically pleasing landscape, and helping to lower urban air temperatures and mitigate the heat island effect . Green roofs are suitable for retrofit or redevelopment projects as well as new buildings and can be installed on small garages or larger industrial, commercial and municipal buildings. They effectively use

1197-615: A centre for contemporary dance in London, has a brown roof specifically designed to encourage the nationally rare black redstart . A green roof, 160 m (520 ft) above ground level, and claimed to be the highest in the UK and Europe "and probably in the world" to act as nature reserve, is on the Barclays Bank HQ in Canary Wharf . Designed combining the principles of green and brown roofs, it

1330-491: A committee that is focused on modern green roof technology. FLL stands for Forschungsgesellschaft Landschaftsentwicklung Landschaftsbau e.V. (German Landscape Research, Development and Construction Society). The FLL is an independent non-profit organization. It was founded in 1975 by eight professional organizations for "the improvement of environmental conditions through the advancement and dissemination of plant research and its planned applications". The FLL green roof working group

1463-450: A defined amount of time from a triggering event. However, Maryland requires an application to the Court in order to file a mechanics liens. In Maryland, corporations must hire an attorney to make an application to the court. Under the statutes, the lien is usually created by the performance of labor or the supplying of material that improves the property. Just what type of contribution counts as

1596-434: A direct contractual agreement with the owner of the land. In fact, this is often the norm because in most cases, the owner of the land contracts only with a general contractor (often called a "prime contractor"). The general contractor, in turn, hires subcontractors ("subs") and material suppliers ("suppliers") to perform the work. These subs and suppliers are entitled to liens on the owner's property to secure their payment from

1729-638: A dramatic effect on maximum surface temperatures, keeping temperatures below the 1961–1990 current form case for all time periods and emissions scenarios. Roof greening makes the biggest difference…where the building proportion is high and the evaporative fraction is low. Thus, the largest difference was made in the town centers". Industrial brownfield sites can be valuable ecosystems, supporting rare species of plants, animals and invertebrates. Increasingly in demand for redevelopment, these habitats are under threat. "Brown roofs", also known as "biodiverse roofs", can partly mitigate this loss of habitat by covering

1862-480: A green roof is the ability to sequester carbon. Carbon is the main component of plant matter and is naturally absorbed by plant tissue. The carbon is stored in the plant tissue and the soil substrate through plant litter and root exudates. A study on green roofs in Michigan and Maryland found the above ground biomass and below ground substrate stored on average between 168 g C m and 107 g C m . Variations occurred among

1995-506: A green roof, roof temperatures on a hot day are typically 1.4–4.4 °C (2.5–7.9 °F) cooler than they are on traditionally roofed buildings nearby. Green roofs are becoming common in Chicago, as well as in Atlanta, Portland, and other United States cities, where their use is encouraged by regulations to combat the urban heat-island effect. Green roofs are a type of low impact development . In

2128-464: A handful of exceptions including Cupertino Ice Center, Tilt Family Entertainment Center (two years later Strike Bowling, then Bowlmor Lanes), and Dynasty Seafood Restaurant, leaving the focus on the second floor. From there, new tenants were pulled in over the next few years. In 2006, Cupertino voters prevented re-zoning of part of the Vallco property for condominiums by overturning a re-zoning ordinance that

2261-831: A large scale. The City of Linz in Austria has been paying developers to install green roofs since 1983, and in Switzerland, it has been a federal law since the late 1990s. In the UK, their uptake has been slow, but a number of cities have developed policies to encourage their use, notably London and Sheffield. Green roofs are also becoming increasingly popular in North America, although they are not as common as in some parts of Europe. Numerous North American cities offer tax incentives to developers who integrate green roofs in their buildings. Toronto and San Francisco legally mandate new buildings to include green roofs. Rooftop water purification

2394-402: A lien waiver that negates the right to file a lien in the future, a lien release cancels a lien that has already in effect. Prior to making any payment, the property owner should request a release of lien from every supplier, contractor and subcontractor, which covers the materials used and the work performed on the project. A release of lien is a written statement that releases the property from

2527-475: A lower level and 50 stores, increasing the total store count from 140 to 190. Ultimately, this expansion was completed in August 1988, adding a total of 60 stores. On the weekend of August 11, 1990, Tilt Family Entertainment Center opened on the lower level (where the original food court used to be). Occupancy began to decline in the 1990s, and the emptying of the mall continued until 2019. One reason for this decline

2660-476: A mechanic's lien and the lien of a mortgage that is financing the construction on the land. For instance, in the State of New York , the appearance of specified language in the mortgage to the effect that it is a construction loan preserves its priority over mechanic's liens arising out of the construction, as long as subsequently filed lien claims that are legitimate are not ignored. In other states, such as Florida , it

2793-414: A mechanic's lien is determined either by the time the lien attaches to the title to the property or by the point in time to which it "relates back." With some exceptions, the lien attaches or relates back to a time prior to the time that any notice of it appears in the public records. In many states, this is specified as the time when the first visible construction commences on the building site. In others, it

2926-487: A minimum of maintenance, perhaps a once-yearly weeding or an application of slow-release fertiliser to boost growth. Extensive roofs are usually only accessed for maintenance. They can be established on a very thin layer of soil (most use specially formulated composts): even a thin layer of rockwool laid directly onto a watertight roof can support a planting of Sedum species and mosses . Some green roof designs incorporate both intensive and extensive elements. To protect

3059-571: A minimum of six stories high. By 31 January 2011, industrial buildings were required to render 10% or 2,000 m (22,000 sq ft) of their roofs green. Toronto City Hall 's Podium roof was renovated to include a 3,000 m (32,000 square feet) rooftop garden, the largest publicly accessible roof in the city. The green roof was opened to the public in June 2010. Many green roofs in Canada also use sustainable rainwater harvesting practices. In 2008,

3192-448: A mix of brick rubble and some concrete has been used. The original idea was to allow the roofs to self-colonise with plants, but they are sometimes seeded to increase their biodiversity potential in the short term. Such practices are derided by purists. The roofs are colonised by spiders and insects (many of which are becoming extremely rare in the UK as such sites are developed) and provide a feeding site for insectivorous birds. Laban ,

3325-428: A person (licensed repair facility) has repaired, furnished supplies or materials, towed or stored a vehicle and has not been paid for the services rendered, that person has a lien against the vehicle. The lien arises at the time the registered owner is presented with a written statement of charges for completed work or services. Although if services were performed that were not agreed upon and no written and signed estimate

3458-473: A plan to demolish the mall and replace it with The Hills at Vallco, a retail, office, and residential development based on a street grid. It was to be covered with the world's largest green roof , to be occupied by a city park. Rafael Viñoly Architects and OLIN Landscape Architects were selected as chief designers of the project. In November 2016, voters rejected two ballot initiatives related to Vallco: Measure C, which would have attempted to freeze Vallco as

3591-527: A residential building through open windows. The additional mass of the soil substrate and retained water places a large strain on the structural support of a building. This makes it unlikely for intensive green roofs to become widely implemented due to a lack of buildings that are able to support such a large amount of added weight as well as the added cost of reinforcing buildings to be able to support such weight. Some types of green roofs do have more demanding structural standards especially in seismic regions of

3724-403: A retail center without offices or housing, in addition to imposing additional restrictions on development options throughout the city, and Measure D, which would have approved the proposed Hills at Vallco project, bypassing standard city approval processes. In the wake of the votes, Sand Hill announced it would stop investing in the mall. Managing Director Reed Moulds said the company "will not sell

3857-437: A revised development plan under the auspices of SB 35 , which has been approved by Cupertino, containing 2,402 apartments, 1.8 million square feet of office space, and 400,000 square feet of retail. Of the apartments, half of them will be affordable with no government subsidies, which would quintuple Cupertino's affordable housing stock. Vallco was formerly anchored by the following department stores: AMC Theatres also left

3990-427: A simpler design than flat green roofs. This is because the pitch of the roof reduces the risk of water penetrating through the roof structure, allowing the use of fewer waterproofing and drainage layers. In ancient times green roofs consisted of cave-like structures or sod roofs covered with earth and plants commonly used for agriculture, dwelling, and ceremonial purposes. These early shelters provided protection from

4123-416: A standard roof. Standard maintenance include removing debris, controlling weeds, deadhead trimming, checking moisture levels, and fertilizing. The maintenance energy use for green roofs has many variables including: climate, intensity of rainfall, type of building, type of vegetation, and external coatings. The most significant effect comes from scarce rainfall which will increase the maintenance energy due to

4256-550: A valid basis for a mechanics lien varies, depending on the particular state statute that applies. Some common examples are: Often, there is no simple dividing line that is useful in every state, or even in every case, for determining this eligibility. Deciding whether a party has a legitimate lien right may depend on examining court cases that have either upheld or rejected lien claims in the same state. Unlike other security interests, in most states, mechanic's liens are given to contractors and material suppliers who may or may not have

4389-409: Is a document that may be voluntarily provided by a lien claimant, such as a subcontractor, in exchange for payment or a promise of payment from a general contractor or a property owner. Negotiations may be tricky, as lien claimants generally want to be paid before they release a lien, while the owner of the property subject to the lien will generally want the lien released before they make payment. Unlike

4522-645: Is already home to a range of rare invertebrates. Green roofs have been increasing in popularity in Australia over the past 10 years. Some of the early examples include the Freshwater Place residential tower in Melbourne (2002) with its Level 10 rooftop Half Acre Garden, CH2 building housing the Melbourne City Council (2006) – Australia's first 6-star Green Star Design commercial office building as certified by

4655-499: Is also being implemented in green roofs. These forms of green roofs are actually treatment ponds built into the rooftops. They are built either from a simple substrate (as being done in Dongtan ) or with plant-based ponds. Plants used include calamus , Menyanthes trifoliata , Mentha aquatica , etc. ) Several studies have been carried out in Germany since the 1970s. Berlin is one of

4788-411: Is an all or nothing proposition. There, the recording of the construction mortgage before the filing of a statutory notice of commencement of construction provides the mortgage with absolute priority over mechanic's liens arising out of the construction. Still other states, such as California , provide priority for a construction loan mortgage recorded before the visible commencement of construction where

4921-414: Is equivalent to 6448 g C m which is significantly greater than 378 g C m Criteria for waste management practices when green roofs reach their end-of-life remain uncodified. Both sod roofs and LWA-based (Lightweight Aggregates) roofs have been found to have a negative impact on the quality of their resulting runoff. Green roofs can be categorized as intensive, semi-intensive, or extensive, depending on

5054-408: Is estimated that the cost of replacing a green roof is generally one third of the initial installation costs. With the initial cost of installing a green roof in mind, there are many financial benefits that accompany green roofing. The main disadvantage of green roofs is that the initial cost of installing a green roof can be double that of a normal roof. Depending on what kind of green roof it is,

5187-402: Is filed correctly. The statutes creating mechanic's liens usually give them a higher priority with respect to other interests in the title than the law gives most real property security interests. Among other things, priority is the attribute that determines which of several competing security claims will have the first claim to the funds of a foreclosure sale . In this context, the priority of

5320-455: Is glassed-in so as to act as a terrarium and passive solar heat reservoir. A concentration of green roofs in an urban area can even reduce the city's average temperatures during the summer, combating the urban heat island effect . Traditional building materials soak up the sun's radiation and re-emit it as heat, making cities at least 4 °C (7.2 °F) hotter than surrounding areas. On Chicago's City Hall, by contrast, which features

5453-422: Is now tying up valuable capital that could be used elsewhere while waiting for the end of a project. In addition, the contractor must bear the cost of litigation in order to enforce their mechanic's lien rights. For disputes of a minor value, a mechanic's lien is not going to be a cost-effective method of obtaining payment for services. A lien release , also known as a release of lien or a cancellation of lien ,

Some of these guidelines also available in English including the German FLL-Guideline for the Planning, Execution and Upkeep of Green-Roof Sites. The results of the research and synthesis done by FLL members are constantly updated and promulgated utilizing the same principles which govern the compilation of DIN standards and are published as either guiding principles or labor instructions. The current Green Roof Guideline

5719-440: Is powerful tool, but not always efficient. In reality, this is a drawn out process that is not very efficient. However, given the economic conditions, and that lenders' usually have priority, the sale of the property may not be sufficient to pay for the value of the lien. What is often overlooked is that the contractor is now financing the project when they perform work and do not receive prompt payment for that work. The contractor

5852-416: Is when the contract is executed for the work to be done. In still others, each contractor or supplier's lien attaches at the time when it commences its own work. Therefore, persons dealing with the owner of the title to the property risk having their interests unexpectedly subject to mechanic's liens of which they had no knowledge. Special provisions are made in some states for determining the priority between

In Texas , the Texas Constitution gives builders the right to lien and sub contractors are given the right under Chapter 53 of the Texas State Property Code A lien against a vehicle that is asserted by an auto mechanic is technically an "artisan's lien" rather than a "mechanic's lien", but it operates in a similar fashion to a mechanic's lien. "The Blueprint to Green Roof Melbourne" is one program being run by the Committee for Melbourne . In 2010, the largest Australian green roof project

6251-598: The Maryland General Assembly , of which the city of Washington was then a part. However, it is not likely that Jefferson single-handedly dreamed up the idea. At the time Jefferson promoted the law, a lien-like privilege already existed in civil law countries like France, the Dutch Republic and Spain, with some laws even tracing their roots to the Roman Empire. And since control of Louisiana had passed between

6384-483: The University of Toronto showed that green roofs can also reduce heat loss and energy consumption in winter conditions. A modeling study found that adding green roofs to 50 percent of the available surfaces in downtown Toronto would cool the entire city by 0.1 to 0.8 °C (0.2 to 1.4 °F). Through evaporative cooling , a green roof reduces cooling loads on a building by fifty to ninety percent, especially if it

6517-642: The Vancouver Convention Centre installed a 2.4-hectare (6-acre) living roof of indigenous plants and grasses on its West building, making it the largest green roof in Canada. The new Canadian War Museum in Ottawa , opened in 2005, also features a grass-covered roof. During the renovation of the Hamilton City Hall in Hamilton, Ontario that spanned from 2007 to 2010, many efforts were taken to enhance

6650-470: The 1960s, and has since spread to many countries. Today, it is estimated that about 10% of all German roofs have been "greened". A number of European Countries have very active associations promoting green roofs, including Germany, Switzerland, the Netherlands, Norway, Italy, Austria, Hungary, Sweden, the UK, and Greece. Germany was the first country to start developing green roof systems and market them on

Mechanic%27s lien A mechanic's lien is a security interest in the title to property for the benefit of those who have supplied labor or materials that improve the property. The lien exists for both real property and personal property . In the realm of real property , it is called by various names, including, generically, construction lien . The term "lien" comes from

Water is stored by the roof's substrate and then taken up by the plants, from which it is returned to the atmosphere through transpiration and evaporation. Green roofs decrease the total amount of runoff and slow the rate of runoff from the roof. It has been found that they can retain up to 75% of rainwater, gradually releasing it back into

7049-529: The French and Spaniards, and had largely adopted the French Napoleonic Code , there was a similar privilege concept in that territory. It seems highly likely that the legislators working on the first U.S. Mechanic Lien laws had knowledge of, and referenced these civil law concepts. Nevertheless, the United States version was original, as it gave builders a more robust right into the land itself (versus just

Beginning in 1986, increased competition from other regional malls such as Stanford Shopping Center and in particular Valley Fair (renovated into an indoor shopping mall that year) began to cause Vallco trouble. 7448-416: The U.S. Department of Energy found a 2 percent reduction in electricity consumption and 9-11% reduction in natural gas when implementing green roofs. A properly designed and installed extensive green-roof system can cost $ 108–$ 248/m ($ 10–$ 23/sq ft) while an intensive green roof costs $ 355–$ 2,368/m ($ 33–$ 220/sq ft) However, since most of the materials used to build the green roof can be salvaged, it

Mechanic's liens on the title to real property are exclusively the result of legislation . Each state has its own laws regarding the creation and enforcement of these liens, but, overall, there are some similar elements among them. Many States distinguish between

7714-404: The amounts owed. Further, there is usually a long list of claimants on any failed project. To avoid the specter of various trades, materialmen and suppliers attempting to remove the improvements they have made, and to maintain a degree of equality between the various lienors on a project, the statutory lien scheme was created. Without it, Tradesperson A may try to "race" Supplier B to the courthouse,

7847-528: The atmosphere via condensation and transpiration , while retaining pollutants in their soil. Many green roofs are installed to comply with local regulations and government fees, often regarding stormwater runoff management. In areas with combined sewer-stormwater systems , heavy storms can overload the wastewater system and cause it to flood, dumping raw sewage into the local waterways. Often, phosphorus and nitrogen are in this category of environmentally harmful substances even though they are stimulating to

The Chicago City Hall green roof is one of the earliest and most well-known examples of green roofs in the United States; it was planted as an experiment to determine the effects a green roof would have on the microclimate of the roof. Many state and municipal governments similarly require contractors on public works projects to be bonded under so-called " Little Miller Acts ." Theoretically, the payment bond under the Miller Act or Little Miller Act stands in place of

8778-403: The course of construction. A temporary construction fence may be required, may serve a valuable function in safety and security, but is never expected to become part of the realty, so therefore is not a cost that is permitted under a mechanic's lien. The attractive nature of the mechanic's lien is that the lien is secured by real property and the property can be sold in order to pay the lien. This

8911-409: The creation and enforcement mechanisms differ depending on whether real or personal property is involved. The law of mechanic's liens on real property governs the creation and enforcement of these liens on items of personal property that have been attached to real property in such a way as to be a fixture . The English common law recognized mechanic's liens respecting only personal property. The lien

9044-733: The depth of planting medium and the amount of maintenance they need. Extensive green roofs traditionally support 50–120 kg/m (10–25 pounds per square foot) of vegetation while intensive roofs support 390–730 kg/m (80–150 pounds per square foot) of vegetation. Traditional roof gardens , which require a reasonable depth of soil to grow large plants or conventional lawns, are considered intensive because they are labour-intensive, requiring irrigation, feeding, and other maintenance. Intensive roofs are more park-like with easy access and may include anything from kitchen herbs to shrubs and small trees. Extensive green roofs, by contrast, are designed to be virtually self-sustaining and should require only

Unfortunately for modern conveniences, these were neither waterproof nor was there any system to keep out unwanted burrowing wildlife. However, green roofs or sod roofs in northern Scandinavia have been around for centuries. The modern trend started when green roofs were developed in Germany in

In August 2019 (ten months after the start of demolition), Sand Hill demolished

9576-409: The environment, maximum shade and mass provide a colorful and functional living roof. The community has the largest number of green roofs in the country. In Egypt , soil-less agriculture is used to grow plants on the roofs of buildings. No soil is placed directly on the roof itself, thus eliminating the need for an insulating layer; instead, plants are grown on wooden tables. Vegetables and fruit are

Simon Fraser University 's Burnaby campus contains a substantial number of green roofs. Canada's first LEED Platinum V4 Home in Wakefield QC, EcoHome's Edelweiss House, has a living Green Roof which is sloped at 12 degrees. Living green roofs have been built and grown at Saint Michael's Sustainable Community since 2012. Native plants, mostly flowers chosen for

9842-406: The fish, because the plants help to keep it clean by absorbing the ammonia. The fish also get some nutrients from the roots of the plants. In Finland, green roofs are still scarce. Some experimental green roofs have been built in big cities. However, the capital city of Helsinki has published guidelines for enhancing the building of green roofs in the city. There is on-going research on the topic as

9975-421: The flat roofs of new developments with a layer of locally sourced material. Construction techniques for brown roofs are typically similar to those used to create flat green roofs, the main difference being the choice of growing medium (usually locally sourced rubble, gravel, soil, etc...) to meet a specific biodiversity objective. In Switzerland, it is common to use alluvial gravels from the foundations; in London,

10108-628: The foraging opportunities these roofs provide. Research at the Javits Center green roof in New York, NY, has shown a correlation between higher numbers of certain insects on the roof, particularly moths, with an increased amount of bat foraging activity. Green roofs also serve as a green wall , filtering pollutants and carbon dioxide out of the air, helping to lower rates of diseases such as asthma. They can also filter pollutants and heavy metals out of rainwater. An additional environmental benefit of

10241-511: The general contractor. However, to have an enforceable lien, it usually must be " perfected ." This means that the holder of the lien must comply with the statutory requirements for maintaining and enforcing the lien. These requirements, which contain time limits, are generally as follows: Because of the difficulty often associated with the filing of mechanics liens and compliance with mechanics lien laws, many lienors use attorneys or mechanics lien filing services to ensure that their mechanics lien

10374-403: The government's property, and qualified claimants make claims against that bond similar to how they would file an ordinary mechanic's lien. In many states, the legislature has created extra procedures in order for a mechanics lien to be placed on residential property. In New Jersey, which enacted the strictest of these regulations, a mechanics lien can only be placed on residential property after

10507-503: The growth of plant life and agriculture. When these substances are added to a system, it can create mass biological activity since they are considered limiting factors of plant growth and by adding more of them to a system, it allows for more plant growth. Green roofs create natural habitat as part of an urban wilderness . Even in high-rise urban settings as tall as 19 stories, it has been found that green roofs can attract beneficial insects, birds, bees and butterflies. A recent list of

10640-556: The improvement's value). With respect to real property, mechanic's liens are purely statutory devices that exist in every state (although in California , as noted below, they have a constitutional foundation). The reason they exist is a legislative public policy to protect contractors . More specifically, the state legislatures have determined that, due to the economics of the construction business, contractors and subcontractors need greater remedy for non-payment for their work than merely

10773-466: The land nor make investments into the current failed asset. In order for us to invest in Vallco we have to be certain it will be a worthwhile investment and not just the Band-Aid approaches that have failed Vallco for decades. Until Cupertino is ready for that approach, we have no choice but to stop". In a follow-up statement, Moulds said that current tenants' leases would be honored so long as they remained at

10906-546: The lender is obligated to disburse the funds. In the State of Illinois , there is a statutory funds disbursing scheme that, if followed, provides construction loan mortgage priority. In other states, there are still other arrangements and some states, such as Colorado , provide almost no practical means for a construction loan mortgage to obtain priority at all. Mechanic's liens are enforced exclusively through judicial foreclosure sales, i.e., through court proceedings similar to mortgage foreclosures. The court must determine whether

11039-450: The lien rights until any of the following conditions occur; otherwise the lien will be considered premature: Each of these required events occur at the end of the project life-cycle (or at the end of the scope of work for the subcontractor, the project may be far from completed). The end of the project may not be remotely close to the actual time when the work was performed (and the time at which labor and materials were paid out of pocket for

11172-427: The maintenance costs could be higher, but some types of green roof have little or no ongoing cost. Some kinds of green roofs also place higher demands on the waterproofing system of the structure, both because water is retained on the roof and due to the possibility of roots penetrating the waterproof membrane. Another disadvantage is that the wildlife they attract may include pest insects which could easily infiltrate

11305-516: The mall on March 22, 2018. Currently, the primary attractions are Bowlmor Lanes and Cupertino Ice Center; Benihana also remains active at the mall in its original location. All of the current occupants have exterior entrances; the interior hallways of the mall have been closed to public access since late 2018. Vallco also formerly hosted the Pacific Coast Farmers' Market in the parking lot behind J. C. Penney. The market's last day at Vallco

11438-463: The mall's Perimeter Road. Due to reduced traffic caused by the COVID-19 pandemic , the demolition had minimal impact on local businesses. The demolition of the bridge was completed on April 8. On September 16, 2021, AB1174 was signed into law, which gives projects (like Vallco) using the special approval of SB35 more time to start construction to compensate for delays caused by lawsuits. A new version of

11571-477: The mall; AMC Theatres, Bowlmor Lanes, Ice Center Cupertino, and Benihana all indicated their intention to stay. However, all vacant areas of the mall would be closed for security reasons, and remaining tenants without lease terms were to be evicted. In May 2017, Sand Hill began implementing the closure of vacant areas, with seven new interior walls erected and a fenced-off section in front of the former Macy's. On March 7, 2018, Sand Hill and AMC Theatres announced that

11704-446: The mechanic would commit the crime of conversion , or embezzlement . On the other hand, the mechanic can assess certain expenditures from the owner that are related to the work performed. These expenditures are normally towing, storage fees, and the cost of filing the lien. If the vehicle is towed by a public agency or private towing company, the lien arises when the vehicle is towed or transported. The lien may be satisfied by selling

11837-405: The most advantageous qualities of extensive and intensive green roofs together. Comprehensive green roofs support plant varieties typically seen in intensive green roofs at the depth and weight of an extensive green roof system. Another important distinction is between pitched green roofs and flat green roofs. Pitched sod roofs , a traditional feature of many Scandinavian buildings, tend to be of

11970-598: The most important centers of green roof research in Germany. Particularly in the last 10 years, much more research has begun. About ten green roof research centers exist in the US and activities exist in about 40 countries. In a recent study on the impacts of green infrastructure , in particular green roofs in the Greater Manchester area, researchers found that adding green roofs can help keep temperatures down, particularly in urban areas: "adding green roofs to all buildings can have

12103-454: The most popular candidates, providing a fresh, healthy source of food that is free from pesticides. A more advanced method, ( aquaponics ), being used experimentally in Egypt, is farming fish next to plants in a closed cycle. This allows the plants to benefit from the ammonia excreted by the fish, helping the plants to grow better and at the same time eliminating the need for changing the water for

12236-419: The movie theater would close on March 22, 2018 – making the 16-screen megaplex's lifespan less than 11 years. In March 2018, Sand Hill proposed a revised mixed-use development plan with an increase from 800 to 2,402 residential units, and still including a rooftop park. The company submitted an application under SB 35 , a 2017 California law that seeks to mitigate the state's housing crisis by eliminating

12369-453: The multifaceted services offered by FBB, which offers a greater degree of market expertise and competitiveness. "Kompetenz im Markt". Today, about 10,000,000 m (110,000,000 square feet) of new green roofs are being constructed each year. According latest studies about 3 ⁄ 4 of these are extensive; the last 1 ⁄ 4 are roof gardens. The cities with the most green roofs in Germany are Berlin and Stuttgart . Surveys about

12502-702: The name Vallco Shopping Mall . In October 2014, Sand Hill Property Co. purchased the Macy's, J. C. Penney, and Sears sites for approximately US$ 200 million. In November 2014, Sand Hill completed purchase of the entire mall for a total of US$ 320 million, the first time the entire mall including the anchor stores had been under the same ownership. In January 2015, J. C. Penney and Macy's announced plans to close their Vallco locations; Sears also announced that its store would close in October 2015. These left Vallco without any anchor tenants . In August 2015, Sand Hill announced

12635-618: The natural functions of plants to filter water and treat air in urban and suburban landscapes. There are two types of green roof: intensive roofs, which are thicker, with a minimum depth of 12.8 cm ( 5 + 1 ⁄ 16  in), and can support a wider variety of plants but are heavier and require more maintenance, and extensive roofs, which are shallow, ranging in depth from 2 to 12.7 cm ( 13 ⁄ 16 to 5 in), lighter than intensive green roofs, and require minimal maintenance. The term green roof may also be used to indicate roofs that use some form of green technology, such as

12768-418: The next level. Serious storm-water issues made cities think about innovative solutions, preferably with living plants. Modern green roof technology with high performance, lightweight materials were used to grow hardy vegetation even on roofs that can hardly support any additional load. In the 1980s modern green roof technology was common knowledge in Germany while it was practically unknown in any other country in

12901-407: The other parking garage under the scope of the original permit (adjacent to the site of the first parking garage), and after receiving a new permit, began demolition of the majority of the mall west of Wolfe Road on August 12. On March 27, 2020, Sand Hill announced that demolition of the bridge over Wolfe Road would commence on March 30. Wolfe Road under the bridge was closed, with traffic detoured onto

13034-421: The owners sold three parcels of land to Evershine Property Management and sold a controlling stake of the mall to Orbit Resources, which switched managing agents from Landmark Property Management to Jones Lang LaSalle. On May 4, 2007, a new 16-screen AMC movie theater opened in the center of the mall, coinciding with the theatrical release of Spider-Man 3 . The grand opening of this highly anticipated film and

13167-589: The plants have been checked at regular intervals since their installation and are still growing and flowering. One species; Tillandsia bergeri , has grown from a single shoot to several thriving colonies. The project is now titled Tillandsia SWARM and has been expanded to include many other buildings across Australia, including Federation Square, National Gallery of Victoria and Essendon Airport. Godman has also experimented with Tillandsia plant screens that can be moved across skylights to create shade in summer and to allow in sun during winter. Temperature readings taken on

13300-545: The project site or the construction lender to obtain payment. Most lien statutes instead mandate strict compliance with the formalized process they create in return for the timely resolution and balancing of claims between all parties involved - both owners and lien claimants. In the state of California, mechanic's liens are a constitutional right guaranteed to contractors by the California Constitution . This right has been implemented in detail by statutes enacted by

13433-459: The project to redevelop the property was submitted in 2023 and finally approved in early 2024. It intends to have more housing, along with some office and retail, and could start construction later in 2024. Green roof A green roof or living roof is a roof of a building that is partially or completely covered with vegetation and a growing medium, planted over a waterproofing membrane . It may also include additional layers such as

13566-405: The property. At the end of the project and after the contractor is paid in full and obtained all of the necessary Releases of Lien and affidavits as described above are obtained, file a Notice of Termination of Notice of Commencement with the Clerk of the Circuit Court in the county where the property being improved is located. States typically have a process by which the land owner may challenge

13699-436: The property. The ability to bond off the lien is especially crucial where developers desire to proceed with the sale of newly built homes, which would otherwise remain unsold and unoccupied during the lien litigation process. Countries that recognize mechanic's liens often provide for very different rights and procedures than those of the United States. Some provinces of Canada (including Quebec ) and New Zealand recognize

13832-406: The property. The property owner should make sure the contractor obtains releases from all of these parties before making final payment. ‹The template How-to is being considered for merging .›   Often a mechanic's lien is discovered long after it has been filed in the public records, but by taking a few proactive measures, property owners can ensure their properties are protected from

13965-424: The region. One of the early features of the mall was the ice skating rink attached to the shopping center. The Ice Capades Chalet, open for almost ten years, began to encounter trouble in 1986, when proposals to close it and replace it with movie theatres emerged (not to be confused with the more recent AMC Theatres, which was instead built on a new third level over the central portion of the mall). By June 3, 1988,

14098-494: The regional shopping center on the edge of the city and gave the proper zoning to Vallco. Vallco Fashion Park held its grand opening at 6:00pm on September 1, 1976. In its first several years, the mall's main walkway was punctuated by several parks showcasing aspects of local history, ranging from apricots to Klystron tubes. Vallco was one of the largest shopping centers in Silicon Valley and soon drew customers from all over

14231-451: The requirement for local approval of certain kinds of developments that include housing. This proposal has been approved by the city. Advisory plans being developed by members of the community through a charrette would include 2,400 residential units and more retail space than Sand Hill's plan. On December 1, 2018, Dynasty Seafood Restaurant closed. Bay Club closed its doors in July 2019, leaving

14364-435: The requirements of the statute have been met and, if so, the priority of the mechanic's lien being foreclosed relative to the other liens or encumbrances on the title. Once that is determined, the court will order the property sold and the proceeds of the sale applied to the liens in the order of their priority. States may have various limitations on mechanic's liens. In California Law a contractor must wait to take advantage of

14497-410: The right to sue on their contracts. In particular, without the mechanics' lien, subcontractors providing either labor or materials may have no effective remedy if their general contractor is not sufficiently financially responsible, because their only contractual right is with that general contractor. Without the mechanic's lien, the contractor would have a limited number of options to enforce payment of

14630-642: The rink faced imminent closure, until the Cupertino City Council stepped in and kept the rink open when faced with vocal protest. At the time, the ice rink was one of two year-round skating rinks nearby – the other being the Ice Capades Chalet at San Mateo Fashion Island. It was also the first place that sold San Jose Sharks merchandise, before the SAP Center (formerly called the San Jose Arena and

14763-436: The roof, a waterproofing membrane is often used, which is manufactured to remain watertight in extreme conditions including constant dampness, ponding water, high and low alkaline conditions and exposure to plant roots, fungi and bacterial organisms. Advances in green roof technology have led to the development of new systems that do not fit into the traditional classification of green roof types. Comprehensive green roofs bring

14896-522: The roofs in a major city were greened, urban temperatures could be reduced by as much as 7 °C (13 °F). Green roofs can reduce stormwater runoff via water-wise gardening techniques. Green roofs play a significant role in retrofitting the Low Impact Development (LID) practices in urban areas. A study presented at the Green Roofs for Healthy Cities Conference in June 2004, cited by

15029-456: The sale proceeds to payment of the amount owed for the workmanship. The sales were non-judicial, i.e., they were held in the same way as a sale of property pawned for a debt. In America, 34 states now appear to have statutes providing for mechanic's liens on personal property. These statutes tend to modify the common law rules. For example, in Virginia , a mechanic's lien can only be enforced up to

15162-517: The status of regulation are done by the FBB. Nearly one third of all German cities have regulations to support green-roof and rain-water technology. Green-roof research institutions are located in several cities as including Hannover , Berlin, Geisenheim and Neubrandenburg . Germany is the country with the most green roofs in the world as well as the country with the most advanced knowledge in modern green roof technology. Green roofs in Germany are part of

15295-443: The substrate depth would allow for more area of carbon storage and diversify the types of plants with greater potential of carbon storage. The direct carbon sequestration techniques and methods can be measured and accounted for. Green roofs also indirectly reduce CO 2 given off by power plants through their ability to insulate buildings. Buildings in the US account for 38% of the total carbon dioxide emissions. A model supported by

15428-445: The theater was heavily marketed towards the students of nearby Cupertino High School . During construction, on February 27, 2006, strong winds toppled a 30-ton crane onto the mall, puncturing a substantial hole in the roof and resulting in water damage to several stores. On July 20, 2007, a new bowling alley called Strike Bowling opened at the former location of Tilt Family Entertainment Center, and access to it from Cupertino Ice Center

15561-410: The threat of lien. If the contract requires partial payments be made before the work is completed in full, then the property owner may request a partial release of lien covering all labor and materials used up to the time of payment. Before final payment, a property owner should obtain an affidavit from the contractor that lists all unpaid parties who performed labor or services, or provided materials to

15694-558: The types of real property upon which a mechanics lien can be filed. Under the principle of sovereign immunity , real property of the government (public property) is ordinarily not subject to the claims of private parties. Therefore, unless the state specifically so provides, mechanic's liens do not attach to the title owned by the state or its administrative subdivisions, such as cities. Similarly, mechanic's liens under state law are invalid on federal construction projects. To protect subcontractors and suppliers working on federal projects where

15827-522: The vehicle through the lien sale process. To conduct a lien sale, the person/lienholder must have possession of the vehicle and may require lien sale authorization from the State's Department of Motor Vehicles , depending on the State and or value of the vehicle. Interested parties, including the registered and legal owners of record will be notified, by Registered Mail, before the sale occurs. Mechanic's liens exist to secure payment for services, labor and material on both personal and real property. However,

15960-450: The watering required. During a 10-year roof maintenance cycle a house with a green roof requires more retrofit embodied energy than a house with a white roof. The individual components of a green roof have CO 2 implications during the manufacturing process have additional implications compared to a conventional roof. The embodied energy for green roof components are 23.6 kg/m (5 pounds per square foot) CO 2 of green roof. This value

16093-487: The work and the amount of bond (if any). It also identifies the property owner, contractor, surety, lender and other pertinent information. A property owner who fails to record a Notice of Commencement or incorrect information on the Notice could result in having to pay twice for the same work or materials. Request a list of all subcontractors and suppliers who have a contract with the contractor to provide services or materials to

16226-429: The work by the contractor). Also, the work must go directly toward the work of improvement of the property. This may seem obvious, but there are numerous construction costs that are not subject to mechanics' liens. A portion of construction costs may not qualify for a mechanic's lien because the work did not improve the property. A good example are items that are not intended to be permanent, but nevertheless, necessary in

16359-515: The world. Some existing buildings cannot be retrofitted with certain kinds of green roofs because of the weight load of the substrate and vegetation exceeds permitted static loading . The weight of a green roof caused the collapse of a large sports hall roof in Hong Kong in 2016. In the wake of the disaster numerous other green roofs around the territory were removed. Green roofs require significantly more maintenance and maintenance energy compared to

16492-423: The world. In Stuttgart, with one of the most innovative Department of Parks and Recreation and with the world's oldest horticultural Universities, modern green roof technology was perfected and implemented on a large scale. By the early 2000s, Germany had laws mandating that many metropolitan areas have green roofs. With the first green roof industry boom in Germany there were quality issues recorded. The FLL formed

16625-462: Was December 30, 2016, after which it relocated to nearby Creekside Park. In the early 1970s, the Cupertino city council held public hearings on the possible locations of a regional shopping center in the city. After it decided the city could only support one center, the Vallco group found itself competing with another group led by orchard owner Paul Mariani Jr. In 1973, the city council decided it wanted

16758-817: Was announced. The Victorian Desalination Project will have a "living tapestry" of 98,000 Australian indigenous plants over a roof area spanning more than 26,000 m (280,000 square feet). The roof will form part of the desalination plant's sophisticated roof system, designed to blend the building into the landscape, and provide acoustic protection, corrosion resistance, thermal control, and reduced maintenance. In June 2014 ecological artist Lloyd Godman , with structural engineer Stuart Jones and environmental scientist Grant Harris collaborated to install an experiment using Tillandsia plants in extreme outdoor conditions at levels 92, 91, 65 and 56 on Eureka Tower in Melbourne, Australia. The selected air plants are extremely light, and are able to grow with no soil or watering system, and

16891-450: Was born from the then-visionary idea of understanding the relationship between nature and constructions not as oppositional, but as an opportunity. Both the green roofing and conventional roofing industries are equally represented. The FBB has developed to become an innovative lobbying group with a strong market presence, internationally known through its cooperation with other European associations. Today, approximately 100 member companies use

17024-416: Was closed off. In November 2010, the bowling alley was renamed Bowlmor Lanes. Renovation of the mall that began in 2005 continued. By 2009, two new parking structures were added to the complex. Future plans at the time included new shops facing the street at the corner of Wolfe Road and Vallco Parkway, a seismic upgrade of the parking garage west of the theaters and the main mall structure, two new hotels, and

17157-402: Was created by operation of law by the fact of the artisan working on the personal property item or attaching additional material to it. However, to maintain the lien, the artisan had to retain possession of the article until he or she was paid. If the property were returned to the owner before that time, the lien was lost. The lien was enforced by a " self-help " sale of the property and applying

17290-403: Was issued beforehand, a mechanic has no right to keep the title owner from reclaiming the vehicle. If a mechanic asserts a fee that is not reasonably related to the work performed, and refuses to return the vehicle until that price is paid, the owner of the vehicle will be able to recoup a storage fee from the mechanic, as the mechanic is in the wrong for refusing to return the vehicle. In doing so

17423-444: Was passed by the city council. The loss of the revenue that was expected from this sale contributed to the financial problems of the owners. The contractor for the movie theater, DPR, filed a mechanic's lien against the owners for approximately US$ 10 million in July 2007, which was settled the following September when Orbit Resources acquired the mall. Vallco Fashion Park's name was changed to Cupertino Square in 2007. Later that year,

17556-470: Was published in 2011. Today most elements of the German FLL are part of standards and guidelines around the world (FM Global, ASTM, NRCA, SPRI etc.). Fachvereinigung Bauwerksbegrünung (FBB) was founded in 1990 as the second green roof association after DDV (Deutscher Dachgaertner Verband) in 1985. FBB was founded as an open forum for manufacturers and planners, merchants and operators in 1990. The organization

17689-428: Was that the selection of mid-range stores didn't reflect the affluence of the surrounding populace. Alan Wong, Emily Chen, and John Nguyen bought Vallco and began renovation of the mostly empty mall in 2005. By 2006, Vallco had the lowest occupancy rate of any mall in the area, at just 24 percent. One of the changes made to Vallco as part of these new renovations was to completely close the mall's lower level in 2005 with
